Each service we offer is covered by its own clear legal documents that clients review and sign when agreeing to an engagement — notably the signed Master Services Agreement (MSA) and Statement of Work (SOW), which (not these Terms) govern paid client work. These Terms reflect our current business practices and will be updated as our services, technologies, and legal obligations evolve.
1. Scope
These Terms govern your use of Neptoniq Creations LLC's public website, contact and intake forms, and any free online tools or portals we make available ("Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.
Paid engagements are governed by a separate signed MSA and SOW. Where these Terms and a signed agreement conflict, the signed agreement controls for that engagement.
2. Acceptable use
You agree not to:
- Use the Services unlawfully or to infringe others' rights.
- Attempt to gain unauthorized access to, disrupt, probe, or overload our systems or networks.
- Submit malware, false identity information, or another person's data without authorization.
- Scrape, resell, or systematically extract content except as expressly allowed.
- Submit a phone number for a callback that you are not authorized to provide.
We may suspend or restrict access to the Services at our discretion to protect the Services or other users.
3. Submissions and communications
If you submit an inquiry or callback request, you confirm the information is accurate and that you are authorized to provide it. Communications and consent records are handled as described in our Privacy Policy and AI & Automation Disclosure.
By providing an email address in our chat or intake tools, you consent to receive transactional and follow-up communications relating to your conversation, including automated summaries and briefs, subject to the opt-out described in our Privacy Policy.
4. SMS/Text Messaging Terms
These terms govern the Neptoniq Creations text-message program.
Who sends and what we send. By opting in, you agree to receive text messages from Neptoniq Creations about your inquiry, appointments, and account, including replies and follow-ups to a service inquiry, appointment and callback confirmations and reminders, and project or account status updates (for example, that a document or brief is ready). Messages may contain a link and a callback phone number. This is a customer-care and account-notification program; we do not send promotional or marketing text messages.
How you opt in. You can opt in by checking the SMS consent box on our contact form or by verbally agreeing during a phone call with our team.
Frequency. Message frequency varies based on your activity.
Rates. Message and data rates may apply depending on your mobile plan.
HELP and STOP. Reply HELP for help, STOP to cancel and stop receiving messages, or START to resubscribe after opting out. After you send STOP, we may send a single confirmation that you have been unsubscribed.
Consent is not a condition. Consent to receive text messages is not a condition of purchasing any goods or services.
Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier and mobile device, and we cannot guarantee that every message will be delivered.

5. Intellectual property

7. No professional advice; AI output
Content and any AI-generated output provided through the Services is for general informational purposes and convenience. It does not constitute legal, financial, medical, or other professional advice, and may contain errors. You are responsible for reviewing and verifying any output before relying on it. 8. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. We describe our efforts, not guaranteed outcomes.
9. Limitation of liability
To the maximum extent permitted by law, Neptoniq Creations LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the free Services will not exceed one hundred U.S. dollars (US$100). Liability on paid engagements is governed by the signed agreement.
10. Indemnification
You agree to indemnify and hold Neptoniq Creations LLC harmless from claims arising out of your misuse of the Services or violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts located in Washoe County, Nevada, unless a signed agreement specifies otherwise.
12. Changes
We may update these Terms; material changes are reflected by a new version number and effective date above. Continued use after changes constitutes acceptance.
